Cabinet approves hearing of Toshakhana 2 case in Adeyala jail

ISLAMABAD: The Federal Cabinet has approved hearing of Toshakhana -2 case against former Prime Minister, Imran Khan, his spouse Bushra Bibi and other at Adeyala jail, Rawalpindi.

On September 12, 2024, the  Cabinet was apprised that the business relating to functions of the Federal Government in respect of Special Courts/Tribunal for Federal subjects stands allocated to Ministry of Law & Justice under the Rules of Business, 1973. It was added that Special Courts (Central), Islamabad were administered by Law & Justice Division.

 It was further informed that the Toshakhana case of National Accountability Bureau (NAB) against  Imran Ahmed Khan Niazi, Bushra Bibi and others had been transferred from the Accountability Court, Islamabad to the Court of Special Judge Central-I, Islamabad, pursuant to the judgment of the Supreme Court of Pakistan.

With reference to the previous decision of Cabinet dated 13th July, 2024, the said NAB Case / Trial was already being conducted at the Central Jail Adeyala, Rawalpindi. Ministry of Interior vide their letter dated 12th September, 2024 had conveyed the apprehensions of the office of Chief Commissioner Islamabad that owing to the previous incidents of law and order and security concerns, the proceedings/trial in the Toshakhana Case by the

Court of Special Judge Central-I, Islamabad may be conducted at the Central Jail Adyala,

Rawalpindi. The Court of Special Judge Central-I, Islamabad was constituted/  established under the Criminal Law Amendment Act, 1958, whereunder the provisions of

Cr.P.C, 1898 apply to the said Court and it is deemed to be a Court of Session.

 Section 9(2) of the Code of Criminal Procedure provides as follows ” (2) The Government may, by general or special order in the official Gazette, direct at what place or places the Court of Session shall hold its sitting; but, until such order is made, the Courts of Session shall hold their sittings as heretofore. In view of section 9(2) of Cr.PC, the Ministry of Law & Justice solicited sanction/approval of the Federal Government to the proposal of the summary, for conducting the proceedings and trial in the case titled State vs. Mr. Imran Ahmad Khan, Bushra Bibi & others by the Court of Special Judge Central-I, Islamabad at Central Jail, Adyala, Rawalpindi.

. The Cabinet considered the summary of September 12, 2024, titled ‘Trial of  Imran Ahmad Khan Niazi and Others by the Special Court Judge Central-I in the Tosha Khana case at Adeyala Jail, Rawalpindi’ submitted by the Law and Justice Division and approved the proposal.

The Cabinet also authorized Secretary Cabinet to issue the decision without waiting for formal approval of the minutes of Cabinet.
